This event definitely seems quite a bit unconstitutional, especially since we're past the emancipation proclamation and the civil rights act. Although there may be a bit of case law or common law that dictates that restaurants can't not serve people of different race, they may be able to dismiss them for certain reasons such as making people feel threatened.
